Raich v. Ashcroft
Randy Barnett is back from the hearing before the Supreme Court on Raich v. Ashcroft. Several weblogs provided coverage of the arguments. Check out The Volokh Conspiracy and Legal Theory Blog. As David Bernstein notes, this case is complicated because of the “statist liberal obssession with ensuring that every aspect of human life may be regulated by the federal government (despite a profound lack of constitutional legitimacy for such a position), and the statist conservative obssession with making marijuana users into criminals.” In other words, both left and right have reasons for wanting this to fail. In typical fashion, federalism is watch you preach to your opponents, not what you practice.
